A Study of Foundations of Hijab’s Obligatoriness and Howness to Deal with Improper Hijab Phenomenon

The culture of Hijab has been common amongst nations and followers of religions in all of the world. At the advent of Islam, many nations and followers of various religions observed the veil, and only polytheists did not have a veil of hijab. Of reasons and basis of Hijab’s necessity in Islam is not only the Qur’anic verses and Islamic narrations but also the principle of “not having evil aspect” and the principle of “respect for the Muslim woman”. After descending of the hijab’s verse at the beginning of Islam, Muslim women observed Hijab effectively. In addition, whenever the infallibles (AS) were faced with improper Hijab, they prevented them by the proper position of preaching. The Imam's (AS) method of propagating Hijab and chastity had a more educational aspect. Therefore, they recommended not only women to wear Hijab but also men to control their look. Since the scope of this phenomenon has various grades in practice, it is not possible to consider a sharp and specific punishment for all of them. Therefore, it has not reported definite Hadd (specific punishment in Shari’at) on this issue in the time of Imams (AS), and in our time Ta'zir (unspecific punishment in Shari’at based on situation) is the best solution.
